1. Introduction

Welcome to Speakeasy Dating, LLC ("Speakeasy"). By accessing or using our platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to both Community Managers ("Hosts") and individual users ("Participants").

2. Eligibility

  • You must be at least 18 years old to use the Platform.

  • By using the Platform, you confirm that you meet this age requirement.

3. User Responsibilities

3.1 Code of Conduct

All users agree to:

  • Treat others with respect and refrain from abusive, discriminatory, or inappropriate behavior.

  • Not share or solicit personal contact information unless mutually agreed upon during a call.

  • Comply with all applicable laws and regulations.

3.2 Restrictions of Use

Users may not:

  • Use the Platform for illegal activities.

  • Harass, harm, or impersonate others.

  • Interfere with the operation of the Platform.

  • Attempt to reverse-engineer or copy the Platform’s functionality.

4. Privacy

  • Speakeasy collects minimal data, including photos, gender, and gender preference, to facilitate matches during events.

  • No user data is retained between events, ensuring anonymity.

5. Payments

  • Users initiating connections will be charged per call.

  • Payments are processed via third-party providers, such as Apple Pay and Google Pay.

  • No refunds are provided except on a case-by-case basis, as determined solely by Speakeasy.

  • All transaction costs associated with payments are included in the fees charged.

6. Event Hosting

  • Hosts can create events and, if opted in, earn revenue through a revenue-sharing model.

  • To participate in revenue sharing, Hosts must opt in and provide a valid email address.

  • Revenue is shared at 50% of the net call fees, after deducting transaction costs.

  • The terms of the revenue-sharing arrangement are governed by a separate legal document, which Hosts must agree to upon opting in.

  • Speakeasy does not guarantee revenue from events.

  • Hosts are responsible for promoting their events to ensure sufficient attendance.

7. Limitation of Liability

  • Speakeasy is not responsible for technical issues, such as call drops or platform interruptions.

  • Speakeasy is not liable for any private information shared between users.

  • The Platform is provided "as is," and Speakeasy disclaims all warranties to the fullest extent permitted by law.

8. Dispute Resolution

  • All disputes shall be resolved through binding arbitration.

  • Arbitration will take place in New Jersey, USA.

  • By using the Platform, you waive your right to bring disputes to court or participate in class-action lawsuits.

9. Termination

  • Speakeasy reserves the right to terminate or suspend access to the Platform for violations of these Terms or other reasons at its sole discretion.

10. Changes to Terms

  • Speakeasy may update these Terms from time to time. Changes will be effective immediately upon posting.

  • Continued use of the Platform constitutes acceptance of the revised Terms.
